Short-Term Rental Agreement
This Short-Term Rental Agreement (“Agreement”) is between Hale Aloha Property Management, LLC (“Host”) and the guest named at signing (“Guest”) for the temporary vacation use of The Pikake A3, located at 3701 Lower Honoapiʻilani Road, Unit A3, Lahaina, Hawaiʻi 96761 (“Property”). Guest is responsible for ensuring everyone in Guest’s party complies with this Agreement, the House Rules, and The Pikake Association rules.
1.Stay, Charges, and Payment
The stay begins on the check-in date and ends on the check-out date for the agreed number of nights. Check-in is no earlier than 3pm HST and checkout is no later than 11am HST unless approved in writing. Changes must be approved by Host and processed through Hospitable or the applicable booking platform.
The total reservation charges are the total agreed amount, which includes rent, mandatory fees and taxes.
An initial booking payment of 50% of the total reservation charges is due when the reservation is confirmed. The remaining 50% is due no later than 7 days before check-in and will be automatically charged to the payment method on file 7 days before check-in. Reservations made fewer than 7 days before check-in require payment in full at booking. The initial payment is applied toward the reservation total and is not a refundable security or damage deposit.
2.Cancellation Policy
Cancellations made 30 or more days before check-in will receive a 100% refund. Cancellations made fewer than 30 days but at least 7 days before check-in will receive a 50% refund. Cancellations made fewer than 7 days before check-in are nonrefundable.
No refunds will be issued for no-shows, late arrivals, early departures, or unused nights. Any refund required by applicable law or the applicable booking platform will be honored. Travel insurance is strongly recommended. If booked through a third-party platform, that platform’s policy controls to the extent it conflicts with this Agreement.
3.Occupancy and Use
Only registered guests may stay overnight. Occupancy may not exceed 3 adults or four total occupants, including children and infants. Unauthorized visitors, parties, events, commercial activity, subletting, and assignment are prohibited. The Property is for temporary vacation use only and may not be used as a permanent residence or place of business.
A material violation may result in termination of the stay in accordance with applicable law and booking-platform policies. Guest remains responsible for resulting damage, costs, and association fines.
4.Pikake Rules and Conduct
Quiet hours are 10:00 p.m.–8:00 a.m. Guests must minimize noise at all times and hold the front door to prevent wind from slamming it. Children must be supervised and may not play in parking areas, driveways, or walkways.
- Do not obstruct or leave belongings in walkways, stairs, driveways, lanais, or common areas.
- Do not hang towels, swimwear, or clothing from lanai railings or windows.
- Barbecuing is prohibited on the lanai and permitted only in the designated BBQ area.
- Association lounge chairs may not be taken onto the beach.
- Do not flush wipes, food, grease, paper towels, feminine products, diapers, or rubbish.
- Gasoline, propane, fireworks, explosives, and other hazardous materials are prohibited.
5.Smoking, Animals, Parking, and Access
The Pikake is a nonsmoking property. Smoking and vaping are prohibited inside the Property, on the lanai, and in all common areas except the designated smoking area.
Pets and other animals are prohibited. Guests requesting a disability-related accommodation must contact Host as early as possible so applicable legal, association, and platform procedures can be followed. Nothing limits rights provided by law.
Parking is limited to one vehicle in the designated parking area. Guest must follow posted signs and may not obstruct or use another unit’s reserved space. No front-office check-in is required.
Access codes are for registered guests only and may not be shared, published, changed, or distributed. Guest must secure doors and windows whenever the Property is unoccupied and at checkout.
6.Property Care, Damage, and Safety
Guest will keep the Property reasonably clean and secure, use furnishings and equipment carefully, and promptly report damage, leaks, safety issues, missing items, or maintenance problems. Guest may not arrange repairs without authorization except for reasonable emergency measures needed to prevent immediate harm.
Guest is responsible for documented damage, missing property, excessive cleaning, unauthorized guests or animals, smoking, rule violations, lost access devices, plumbing misuse, and association fines caused by Guest’s party. The absence of a security deposit does not eliminate this responsibility. Host may seek documented charges through Hospitable, the booking platform, or other lawful means.
The bedroom contains the Property’s only air conditioner; the living area has ceiling fans and natural ventilation. Doors and windows must remain closed while the A/C operates. Guest may not reset or alter internet, A/C, utility, or safety equipment.
Shared coin-operated laundry is available; there is no washer or dryer inside the condo. Starter supplies are provided, and Guest is responsible for additional supplies needed during the stay.
7.Ocean, Beach Equipment, and Personal Property
Beach chairs, an umbrella, and beach towels are provided and must be returned after use. Ocean, beach, snorkeling, swimming, surfing, kayaking, and other recreational activities involve inherent risks. Conditions can change without warning. Guest is responsible for evaluating conditions, following posted warnings, supervising minors, and deciding whether an activity is safe.
To the extent permitted by law, Guest assumes risks associated with voluntary recreational activities. Host is not responsible for lost, stolen, damaged, or abandoned personal property except where responsibility cannot legally be excluded. Guest is responsible for packing and shipping costs for returned items; unclaimed items may be discarded or donated after 30 days where permitted by law.
8.Maintenance and Entry
Guest must promptly report problems and allow a reasonable opportunity for correction. Host will make reasonable efforts to address issues but cannot guarantee uninterrupted utilities, internet, appliances, A/C, laundry equipment, or association amenities. Any adjustment will be determined under applicable law and the policy governing the reservation.
Host or an authorized representative may enter when reasonably necessary for an emergency, to prevent damage, investigate a reported issue, perform urgent service, address a rule violation, or as otherwise permitted by law. Host will attempt advance notice except when immediate entry is reasonably necessary.
9.Checkout
Guest must vacate by 11:00 a.m. HST unless otherwise approved in writing. Before departure, Guest must wash used dishes, leave used towels in the bathroom, return beach supplies, turn off the A/C, lights, fans, and appliances, remove personal belongings, and lock all windows and doors.
Bag household trash and place it in the designated dumpster. Guest should notify Host if departing substantially before 11:00 a.m.
10.Events Beyond Control and Liability
Cancellations or interruptions caused by severe weather, natural disaster, wildfire, utility outage, government action, road or airline disruption, civil emergency, or association closure are governed by applicable law and the reservation’s cancellation policy. Travel insurance is strongly recommended.
To the extent permitted by law, Guest accepts responsibility for use of the Property, common areas, beach equipment, and surrounding ocean and beach. Guest will indemnify Host, the Property owner, and authorized representatives from third-party claims resulting from the negligent, reckless, unlawful, or intentional conduct of Guest’s party. Nothing waives liability that cannot legally be excluded.
11.Governing Terms
This Agreement is governed by Hawaiʻi law. Subject to any controlling platform procedure or law, court proceedings will be brought in the appropriate court serving Maui County. This Agreement, the reservation confirmation, cancellation policy, House Rules, and association rules constitute the agreement governing the stay. If any provision is unenforceable, the remainder continues in effect. Changes must be confirmed in writing.
12.Electronic Signature and Contacts
An electronic signature has the same effect as a handwritten signature. Guest confirms that Guest is at least 25 years old, is legally able to enter this Agreement, has reviewed the reservation terms, and accepts responsibility for Guest’s party.
